Buying property off-plan in Bulgaria in 2026: which guarantees to require from the developer?

Buying property «off-plan» (a so-called «na zeleno» deal) has traditionally attracted buyers in Bulgaria with more favourable prices and the opportunity to choose the best layout or floor. By 2026 the Bulgarian property market has entered a mature phase. Buyers have become more demanding regarding transaction safety. A simple promise that «everything will be built on time» is not enough. To minimise risks and protect your investment, you need to approach the choice of a developer strategically. In this article we have prepared for you an up-to-date checklist: which documents and guarantees you should require from a construction company in 2026.

Market context 2026: why caution is needed when buying an apartment at the excavation stage

Over recent years the construction sector in Bulgaria has faced rising prices of building materials and tighter banking conditions. In 2026 a clear trend has emerged: only financially stable players remain on the market, but oversight on the buyer’s side must still be maximal.

Inflation risks and changes in supply chains are forcing investors to draft contract terms more carefully in order to avoid a hidden increase in the price per square metre during the construction process.

Buyer’s checklist: checking the developer and demanding guarantees

If you are planning an «off-plan» purchase in Sofia, Plovdiv, Varna, Burgas or at the resorts, go through the following points before signing the Preliminary Contract (Predvaritelen dogovor).

Financial history and history of projects

The first thing to start with is checking the legal entity. Study the Commercial Register (Targovski registar): check whether the company has any open court proceedings, debts to the state or signs of bankruptcy.

  • Portfolio. How many projects has the developer put into operation (obtained Act 16).

Were there any delays on past projects? In 2026 reputation is the main capital of a construction company.

Land documents and building permit

Construction cannot be considered legal without two basic elements:

  • Ownership of the land (or the right to build – otstapeno pravo na stroezh): make sure that the plot under the future building is not encumbered with mortgages that you are not aware of.
  • Building permit (Razreshenie za stroezh): it must have entered into force. Buying a property before obtaining this document is an unjustified risk.

How is the project financed?

This is one of the most important questions. Find out whether the project is being built with the developer’s «own funds», through project financing from a bank, or exclusively with money from future buyers (the last option is the riskiest).

Expert tip: project financing from a major Bulgarian bank is a good sign. Banks carry out a strict audit of the developer before granting a loan, which serves as an additional safety filter for you.

Clear payment schedules linked to the Acts

Forget about schemes with a one hundred percent prepayment «off-plan». The safety standard in 2026 is staged payment, strictly linked to the stages of construction:

  • Act 14 (a Bulgarian construction document confirming completion of the «rough construction» stage. It is issued after the foundations, load-bearing walls, floor slabs and roof of the building have been erected. This act means that the structure is ready).
  • Act 15 (the building is fully ready, network tests have been carried out).
  • Act 16 (Permit for putting into operation).

The greater the percentage of the amount you leave for the stage of obtaining Act 16, the more strongly your interests are protected.

Clause on price indexation in the contract

In recent years some developers have tried to include in contracts clauses on unilateral price indexation due to inflation.

In 2026 demand a fixed price in the Preliminary Contract

If an indexation clause is present, it must be clearly reasoned (for example, tied to the official inflation index of the NSI) and have a «cap» (no more than 3-5%), or give you the right to terminate the contract with a full refund without penalties if the price rises above a certain level.

Penalties for missed deadlines

The contract must set out not merely abstract completion deadlines (Act 14, 15, 16), but also specific penalty sanctions for each day or month of delay. It must also state your right to terminate the contract if the delay exceeds a critical period (for example, more than 6 months).

How to protect yourself to the maximum

Buying property at the excavation stage in Bulgaria in 2026 remains an excellent way to save money and obtain modern, energy-efficient housing. However, the main rule of safety is engaging independent experts.

Do not rely solely on the developer’s own lawyers. Our real estate agency provides a full legal check of the developer, an analysis of the history of their projects and an audit of the Preliminary Contract before the transaction. We act on the side of the buyer, guaranteeing that your investment is protected by law and reliable contracts.
